فضل الصحابة رضوان الله عليهم

أرجو توضيحاً في فضل الصحابة ، وما هي مميزاتهم عن غيرهم ؟.


الحمد لله
اعتقاد عدالةِ الصحابة وفضلهم هو مذهبُ أهلِ السنة والجماعة ، وذلك لما أثنى اللهُ تعالى عليهم في كتابه ، ونطقت به السنَّةُ النبويةُ في مدحهم ، وتواتر هذه النصوص في كثير من السياقات مما يدل دلالة واضحة على أن الله تعالى حباهم من الفضائل ، وخصهم من كريم الخصال ، ما نالوا به ذلك الشرف العالي ، وتلك المنزلة الرفيعة عنده ؛ وكما أن الله تعالى يختار لرسالته المحل اللائق بها من قلوب عباده ، فإنه سبحانه يختار لوراثة النبوة من يقوم بشكر هذه النعمة ، ويليق لهذه الكرامة ؛ كما قال تعالى : ( اللَّهُ أَعْلَمُ حَيْثُ يَجْعَلُ رِسَالَتَهُ) الأنعام/ 124 . 

قال ابن القيم رحمه الله : " فالله سبحانه أعلم حيث يجعل رسالاته أصلا وميراثا ؛ فهو أعلم بمن يصلح لتحمل رسالته فيؤديها إلى عباده بالأمانة والنصيحة ، وتعظيم المرسل والقيام بحقه ، والصبر على أوامره والشكر لنعمه ، والتقرب إليه ، ومن لا يصلح لذلك ، وكذلك هو سبحانه أعلم بمن يصلح من الأمم لوراثة رسله والقيام بخلافتهم ، وحمل ما بلغوه عن ربهم " طريق الهجرتين ، ص (171) . 

وقال تعالى : ( وَكَذَلِكَ فَتَنَّا بَعْضَهُمْ بِبَعْضٍ لِيَقُولُوا أَهَؤُلاءِ مَنَّ اللَّهُ عَلَيْهِمْ مِنْ بَيْنِنَا أَلَيْسَ اللَّهُ بِأَعْلَمَ بِالشَّاكِرِينَ) الأنعام/53 . 

قال الشيخ السعدي رحمه الله : " الذين يعرفون النعمة ، ويقرون بها ، ويقومون بما تقتضيه من العمل الصالح ، فيضع فضله ومنته عليهم ، دون من ليس بشاكر . فإن الله تعالى حكيم ، لا يضع فضله ، عند من ليس له أهل . " 

وكما جاءت الآيات والأحاديث بفضلهم وعلو منزلتهم ، جاءت أيضا بذكر الأسباب التي استحقوا بها هذه المنازل الرفيعة ، ومن ذلك قوله تعالى :
( مُّحَمَّدٌ رَّسُولُ اللَّهِ وَالَّذِينَ مَعَهُ أَشِدَّاء عَلَى الْكُفَّارِ رُحَمَاء بَيْنَهُمْ تَرَاهُمْ رُكَّعاً سُجَّداً يَبْتَغُونَ فَضْلاً مِّنَ اللَّهِ وَرِضْوَاناً سِيمَاهُمْ فِي وُجُوهِهِم مِّنْ أَثَرِ السُّجُودِ ذَلِكَ مَثَلُهُمْ فِي التَّوْرَاةِ وَمَثَلُهُمْ فِي الإنجِيلِ كَزَرْعٍ أَخْرَجَ شَطْأَهُ فَآزَرَهُ فَاسْتَغْلَظَ فَاسْتَوَى عَلَى سُوقِهِ يُعْجِبُ الزُّرَّاعَ لِيَغِيظَ بِهِمُ الْكُفَّارَ وَعَدَ اللَّهُ الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ مِنْهُم مَّغْفِرَةً وَأَجْراً عَظِيماً ) الفتح/29 

ومن أعظم موجبات رفعة مكانة الصحابة ، ما شهد الله تعالى لهم من طهارة القلوب ، وصدق الإيمان ، وتلك – والله - شهادة عظيمة من رب العباد ، لا يمكن أن ينالها بَشَر بعد انقطاع الوحي .
اسمع قوله سبحانه وتعالى : ( لَقَدْ رَضِيَ اللَّهُ عَنِ الْمُؤْمِنِينَ إِذْ يُبَايِعُونَكَ تَحْتَ الشَّجَرَةِ فَعَلِمَ مَا فِي قُلُوبِهِمْ فَأَنزَلَ السَّكِينَةَ عَلَيْهِمْ وَأَثَابَهُمْ فَتْحاً قَرِيباً ) الفتح/18 

قال ابن كثير رحمه الله في "تفسير القرآن العظيم" (4/243) :
" فعلم ما في قلوبهم : أي : من الصدق والوفاء والسمع والطاعة " انتهى . 

وما أحسن ما قال عبد الله بن مسعود رضي الله عنه : " من كان منكم مستنا فليستن بمن قد مات ؛ فإن الحي لا تؤمن عليه الفتنة ؛ أولئك أصحاب محمد صلى الله عليه وسلم كانوا أفضل هذه الأمة ؛ أبرها قلوبا وأعمقها علما وأقلها تكلفا ، قوم اختارهم الله لصحبة نبيه وإقامة دينه ، فاعرفوا لهم فضلهم واتبعوهم في آثارهم ، وتمسكوا بما استطعتم من أخلاقهم ودينهم ، فإنهم كانوا على الهدى المستقيم " رواه ابن عبد البر في الجامع ، رقم (1810) . 

وقد وعد الله المهاجرين والأنصار بالجنات والنعيم المقيم ، وأحَلَّ عليهم رضوانه في آيات تتلى إلى يوم القيامة ، فهل يعقل أن يكون ذلك لمن لا يستحق الفضل !؟ 

يقول سبحانه وتعالى : ( وَالسَّابِقُونَ الأَوَّلُونَ مِنَ الْمُهَاجِرِينَ وَالأَنصَارِ وَالَّذِينَ اتَّبَعُوهُم بِإِحْسَانٍ رَّضِيَ اللّهُ عَنْهُمْ وَرَضُواْ عَنْهُ وَأَعَدَّ لَهُمْ جَنَّاتٍ تَجْرِي تَحْتَهَا الأَنْهَارُ خَالِدِينَ فِيهَا أَبَداً ذَلِكَ الْفَوْزُ الْعَظِيمُ ) التوبة/100 

وقد شهد لهم بالفضل سيد البشر وإمام الرسل والأنبياء ، فقد كان شاهدا عليهم في حياته ، يرى تضحياتهم ، ويقف على صدق عزائمهم ، فأرسل صلى الله عليه وسلم كلمات باقيات في شرف أصحابه وحبه لهم . 

عن أبي هريرة رضي الله عنه قال رسول الله صلى الله عليه وسلم : ( لا تَسُبُّوا أَصحَابِي ؛ فَوَالَّذِي نَفسِي بِيَدِهِ لَو أَنَّ أَحَدَكُم أَنفَقَ مِثلَ أُحُدٍ ذَهَبًا مَا أَدرَكَ مُدَّ أَحَدِهِم وَلا نَصِيفَهُ ) رواه البخاري (3673) ومسلم (2540) 

وعن عبدالله بن مسعود رضي الله عنه عن النبي صلى الله عليه وسلم قال : ( خَيرُ النَّاسِ قَرنِي ، ثُمَّ الَّذِينَ يَلُونَهُم ، ثُمَّ الَّذِينَ يَلُونَهُم ) رواه البخاري (2652) ومسلم (2533) 

يقول الخطيب البغدادي رحمه الله في "الكفاية" (49) :
" على أنه لو لم يرد من الله عز وجل ورسوله فيهم شيء ، لأوجبت الحال التي كانوا عليها من الهجرة ، والجهاد ، والنصرة ، وبذل المهج والأموال ، وقتل الآباء والأولاد ، والمناصحة في الدين ، وقوة الإيمان واليقين ، القطعَ على عدالتهم ، والاعتقاد لنزاهتهم ، وأنهم أفضل من جميع المعدلين والمزكين الذين يجيؤون من بعدهم أبد الآبدين ، هذا مذهب كافة العلماء ، ومن يعتد بقوله من الفقهاء " انتهى

ولو ذهبنا نسرد مواقفهم التي نصروا فيها الدين ، وأعمالهم التي استحقوا بها الرفعة والمنزلة العالية ، لما كفتنا المجلدات الطوال ، فقد كانت حياتهم كلها في سبيل الله تعالى ، وأي قرطاس يسع حياة المئات من الصحابة الذين ملؤوا الدنيا بالخير والصلاح . 

يقول ابن مسعود رضي الله عنه :
" إن الله نظر في قلوب العباد ، فوجد قلب محمد صلى الله عليه وسلم خير قلوب العباد ، فاصطفاه لنفسه ، فابتعثه برسالته ، ثم نظر في قلوب العباد بعد قلب محمد ، فوجد قلوب أصحابه خير قلوب العباد ، فجعلهم وزراء نبيه ، يقاتلون على دينه ، فما رأى المسلمون حسنا فهو عند الله حسن ، وما رأوا سيئا فهو عند الله سيئ " انتهى
رواه أحمد في "المسند" (1/379) وقال المحققون : إسناده حسن .

ثانيا :
لا بدَّ أن نعلم أن الصحابة رضي الله عنهم ليسوا بمعصومين ، وهذا هو مذهبُ أهل السنة والجماعة ، وإنما هم بشرٌ يجوزُ عليهم ما يجوز على غيرهم .
وما صدر من بعضهم من المعاصي أو الأخطاء ، فهو إلى جانبِ شرفِ الصحبة وفضلِها مُغْتَفَرٌ ومَعْفُوٌّ عن صاحبه ، والحسناتِ يُذْهِبْنَ السيئات ، ومقامُ أَحَدِ الصحابة مع النبي صلى الله عليه وسلم لحظة من اللحظات في سبيل هذا الدين لا يعدلها شيء .
يقول شيخ الإسلام رحمه الله : " وأهل السنة تحسن القول فيهم وتترحم عليهم وتستغفر لهم ، لكن لا يعتقدون العصمة من الإقرار على الذنوب وعلى الخطأ في الاجتهاد إلا لرسول الله ، ومن سواه فيجوز عليه الإقرار على الذنب والخطأ ، لكن هم كما قال تعالى : ( أُولَئِكَ الَّذِينَ نَتَقَبَّلُ عَنْهُمْ أَحْسَنَ مَا عَمِلُوا وَنَتَجَاوَزُ عَنْ سَيِّئَاتِهِمْ ) الاحقاف/16 الآية ، وفضائل الأعمال إنما هي بنتائجها وعواقبها لا بصورها "

وقد قرر ذلك الكتاب والسنة في أكثر من موقف :
فقد تجاوزَ الله سبحانه وتعالى عمن تولى يوم أُحُدٍ من الصحابة ، فقال سبحانه وتعالى : ( إِنَّ الَّذِينَ تَوَلَّوْاْ مِنكُمْ يَوْمَ الْتَقَى الْجَمْعَانِ إِنَّمَا اسْتَزَلَّهُمُ الشَّيْطَانُ بِبَعْضِ مَا كَسَبُواْ وَلَقَدْ عَفَا اللّهُ عَنْهُمْ إِنَّ اللّهَ غَفُورٌ حَلِيمٌ ) آل عمران/155
ولما أذنب بعض الصحابة حين أخبر قريشا بمقدم النبي صلى الله عليه وسلم بالجيش عام الفتح ، وهَمَّ عمر بن الخطاب رضي الله عنه بقتله ، قال صلى الله عليه وسلم : ( إِنَّهُ قَد شَهِدَ بَدرًا ، وَمَا يُدرِيكَ ؟ لَعَلَّ اللَّهَ اطَّلَعَ عَلَى أَهلِ بَدرٍ فَقَالَ : اعمَلُوا مَا شِئتُم ، فَقَد غَفَرتُ لَكُم ) رواه البخاري ومسلم (2494) 

وغير ذلك من المواقف التي وقع فيها بعض الصحابة بالمعصية والذنب ، ثم عفا الله تعالى عنهم ، وغفرها لهم ، مما يدل على أنهم يستحقون الفضل والشرف ، وأنه لا يقدح في ذلك شيء مما وقعوا فيه في زمن النبي صلى الله عليه وسلم أو بعد وفاته ، فإن الآيات السابقة في فضلهم وتبشيرهم بالجنة ، أخبار لا ينسخها شيء .

The virtue of the Sahaabah (may Allaah be pleased with them
 I hope that you can explain the virtue of the Sahaabah and what distinguishes them from others?.
Praise be to Allaah.
Belief in the good character and virtue of the Sahaabah is the belief of Ahl al-Sunnah wa’l-Jamaa’ah. That is because Allaah has praised them in His Book and they were also praised by the Prophet (peace and blessings of Allaah be upon him) as is narrated in the books of Sunnah. These texts reach the level of mutawaatir in many cases, which clearly indicates that Allaah gave them special virtues and noble characteristics, by means of which they attained that great honour and high status with Him. As Allaah chose for His message the most pure-hearted of His slaves (i.e., the Prophets), so too He chose as the heirs of the Prophets those who would be grateful for this blessing and who were fit for this honour (of conveying the message), as He says (interpretation of the meaning): 
“Allaah knows best with whom to place His Message”
[al-An’aam 6:124] 
Ibn al-Qayyim (may Allaah have mercy on him) said: Allaah knows best where to place His Message, both with regard to the original recipient and those who inherit it from him. He knows best who is fit to receive His Message and convey it to His slaves in a trustworthy and sincere manner, respecting the Sender and fulfilling his duties towards Him, patiently following His commands and showing gratitude for His blessings and drawing close to Him, and He knows who is not fit for that. Similarly, He knows best who among the nations is fit to be the heirs of His Messengers and to succeed them and convey the Message that they received from their Lord. 
Tareeq al-Hijratayn, p. 171 
Allaah says (interpretation of the meaning): 
“Thus We have tried some of them with others, that they might say: ‘Is it these (poor believers) whom Allaah has favoured from amongst us?’ Does not Allaah know best those who are grateful?”
[al-An’aam 6:53] 
Shaykh al-Sa’di (may Allaah have mercy on him) said: Those who acknowledge the blessing and affirm it, and who do what it requires of righteous deeds, are the ones on whom Allaah bestows His blessing, to the exclusion of those who are not grateful, for Allaah is wise and He does not place His bounty with one who is not qualified to receive it. 
Just as there are many verses and ahaadeeth which speak of their virtue and high status, so too there are texts which state the reasons why they deserved this high status, such as the verse in which Allaah says (interpretation of the meaning): 
“Muhammad is the Messenger of Allaah. And those who are with him are severe against disbelievers, and merciful among themselves. You see them bowing and falling down prostrate (in prayer), seeking Bounty from Allaah and (His) Good Pleasure. The mark of them (i.e. of their Faith) is on their faces (foreheads) from the traces of prostration (during prayers). This is their description in the Tawraat (Torah). But their description in the Injeel (Gospel) is like a (sown) seed which sends forth its shoot, then makes it strong, and becomes thick and it stands straight on its stem, delighting the sowers, that He may enrage the disbelievers with them. Allaah has promised those among them who believe (i.e. all those who follow Islamic Monotheism, the religion of Prophet Muhammad till the Day of Resurrection) and do righteous good deeds, forgiveness and a mighty reward (i.e. Paradise)”
[al-Fath 48:29] 
Among the greatest reasons for the high status of the Sahaabah is that to which Allaah bore witness of their purity of heart and sincere faith. That, by Allaah, is a mighty testimony from the Lord of mankind, which no human being can attain after the cessation of the Revelation. 
Listen to the words of Allaah (interpretation of the meaning): 
“Indeed, Allaah was pleased with the believers when they gave the Bay‘ah (pledge) to you (O Muhammad) under the tree, He knew what was in their hearts, and He sent down As‑Sakeenah (calmness and tranquillity) upon them, and He rewarded them with a near victory”
[al-Fath 48:18] 
Ibn Katheer (may Allaah have mercy on him) said in Tafseer al-Qur’aan al-‘Azeem (4/243): 
“He knew what was in their hearts” i.e., of sincerity and loyalty, and the willingness to hear and obey. End quote. 
How beautiful are the words of ‘Abd-Allaah ibn Mas’ood (may Allaah be pleased with him): “Whoever among you wishes to follow (someone), let him follow one who has died, for the one who is still alive is not safe from fitnah. The companions of Muhammad (peace and blessings of Allaah be upon him) were the best of this ummah, the most righteous of heart and the deepest in knowledge and the most straightforward, people whom Allaah chose to accompany His Prophet and establish His religion. So acknowledge their virtue and follow in their footsteps, and adhere as much as you can to their morals and religion, for they were following right guidance. 
Narrated by Ibn ‘Abd al-Barr in al-Jaami’, no. 1810. 
Allaah promised Paradise and eternal bliss to the Muhaajireen and Ansaar, and He stated that He is pleased with them in verses that will be recited until the Day of Resurrection. Can anyone think that this would be given to one who does not deserve that bounty? 
Allaah, may He be glorified and exalted says (interpretation of the meaning): 
“And the foremost to embrace Islam of the Muhaajiroon and the Ansaar and also those who followed them exactly (in Faith). Allaah is well-pleased with them as they are well-pleased with Him. He has prepared for them Gardens under which rivers flow (Paradise), to dwell therein forever. That is the supreme success”
[al-Tawbah 9:100] 
The leader of mankind, the foremost among the Messengers and Prophets, also testified to their virtue. He was a witness over them during his lifetime; he saw their sacrifices and their sincere resolve, and he (peace and blessings of Allaah be upon him) spoke immortal words of the honour of his companions and his love for them.  
It was narrated from Abu Hurayrah (may Allaah be pleased with him) that the Messenger of Allaah (peace and blessings of Allaah be upon him) said: “Do not revile my companions, for by the One in Whose hand is my soul, if one of you were to spend the equivalent of Uhud in gold, it would not amount to a mudd of one of them, or half of that.” Narrated by al-Bukhaari (3673) and Muslim (2540). 
It was narrated from ‘Abd-Allaah ibn Mas’ood (may Allaah be pleased with him) that the Prophet (peace and blessings of Allaah be upon him) said: “The best of the people are my generation, then those who come after them, then those who come after them.” Narrated by al-Bukhaari (2652) and Muslim (2533). 
Al-Khateeb al-Baghdaadi (may Allaah have mercy on him) said in al-Kifaayah (49): 
Even if there was nothing narrated from Allaah or His Messenger about them, the things that they did such as migrating (hijrah), engaging in jihad, supporting (the Prophet (peace and blessings of Allaah be upon him) and Islam), expending their lives and their wealth, killing their fathers and sons (in jihad), sincerely following the deen, believing strongly and with certainty, is definitive proof of their good character and sincerity, and shows that they are superior to all those sincere people of good character who come after them, for all time. This is the view of all the scholars, and of the fuqaha’ whose opinion counts. End quote. 
If we were to list the attitudes with which they supported the deen and the righteous deeds by means of which they deserved that high status, we would fill volumes. Their whole lives were spent for the sake of Allaah and what book is big enough to contain the lives of hundreds of the Sahaabah who filled the world with goodness and righteousness? 
Ibn Mas’ood (may Allaah be pleased with him) said: 
Allaah looked into the hearts of His slaves, and He saw that the heart of Muhammad (peace and blessings of Allaah be upon him) was the best of people’s hearts, so He chose him for Himself and sent him with His message. Then He looked into the hearts of His slaves after the heart of Muhammad, and He found that the hearts of his companions were the best of people’s hearts, so He made them the supporters of His Prophet, who fought for His religion. So whatever the Muslims think is good, is good before Allaah, and whatever they think is bad, is bad before Allaah. End quote. 
Narrated by Ahmad in al-Musnad (1/379). The scholars of hadeeth said: Its isnaad is hasan.

Secondly: 
It is essential to understand that the Sahaabah were not infallible. This is the view of Ahl al-Sunnah wa’l-Jamaa’ah. Rather they were human beings like any others.  
Whatever sins or mistakes any of them may have made maybe overlooked in comparison to the honour of accompanying the Prophet (peace and blessings of Allaah be upon him) and they were forgiven and pardoned. Good deeds take away bad deeds. The support that the Sahaabah gave to the Prophet (peace and blessings of Allaah be upon him) at any given moment for the sake of this religion cannot be matched. 
Shaykh al-Islam Ibn Taymiyah (may Allaah have mercy on him) said:  
Ahl al-Sunnah speak well of them, and pray for mercy and forgiveness for them, but they do not believe that anyone is infallible or that anyone is protected from making mistakes in their ijtihaad except the Messenger of Allaah; it is possible for anyone else to commit sins or make mistakes, but they are as Allaah says (interpretation of the meaning): 
“They are those from whom We shall accept the best of their deeds and overlook their evil deeds. (They shall be) among the dwellers of Paradise ___ a promise of truth, which they have been promised”
[al-Ahqaaf 46:16]. 
The virtue of any deeds is to be judged by the results and consequences. Majmoo’ al-Fataawa, 4/434. 
This is confirmed in the Qur'aan and Sunnah, in more than one place. 
Allaah forgave those of the Sahaabah who turned back on the day of Uhud, as He says (interpretation of the meaning): 
“Those of you who turned back on the day the two hosts met (i.e. the battle of Uhud), it was Shaytaan (Satan) who caused them to backslide (run away from the battlefield) because of some (sins) they had earned. But Allaah, indeed, has forgiven them. Surely, Allaah is Oft‑Forgiving, Most Forbearing”
[Aal ‘Imraan 3:155] 
When one of the Sahaabah sinned by telling Quraysh that the Prophet (peace and blessings of Allaah be upon him) was coming with the army during the year of the Conquest, and ‘Umar ibn al-Khattaab wanted to execute him, the Prophet (peace and blessings of Allaah be upon him) said: “He was present at Badr, and you do not know, perhaps Allaah looked upon the people of Badr and said: ‘Do what you wish, for I have forgiven you.’”  Narrated by al-Bukhaari and Muslim (2494). 
And there are other cases in which some of the Sahaabah committed sins, then Allaah, may He be exalted, pardoned them and forgave them, which is indicative of their virtue and honour and that cannot be undermined by any mistake that they made during the time of the Prophet (peace and blessings of Allaah be upon him) or after he died. The verses quoted above, which speak of their virtue and give them the glad tidings of Paradise, cannot been abrogated by anything.

هل ترضع طفلها أمام النساء


السؤال:
رزقنى الله بطفلة ، وفى كثير من الأحيان يكون معي أقاربي أو صديقاتي أو أكون أنا عندهم وأرضع الطفلة .. فهل حرام أن أكشف صدري وأرضع الطفلة أمامهم ، لأنني أخاف إذا قمت وأرضعتها بعيدا عنهم أن يفهم ذلك خطأ.. مع العلم أننى لا أرضعها إلا أمام نساء أو أطفال . ولكم جزيل الشكر .


الجواب :
الحمد لله
سبق بيان ما يجوز للمرأة أن تبديه أمام محارمها ، وأمام النساء ، وينظر : سؤال رقم (113287)ورقم (82994)ورقم(34745)، ورقم(115351)، وحاصله أنها لا تكشف أمام النساء إلا ما يظهر غالبا .
وأما إخراجها الثدي لترضع ولدها ، فقد رخص فيه أهل العلم ، للحاجة .
قال الشيخ ابن عثيمين رحمه الله :
" يجب أن نعلم أن هناك فرقاً بين قولنا: ما هي العورة؟ وبين قولنا: ما هو اللباس الذي يُشرع للمرأة أن تلبسه، حتى لا يكون اختلاط بين الأمرين.
اللباس الذي يُشرع للمرأة أن تلبسه: أن يكون سابغاً لجميع البدن ما عدا الرأس والكفين والقدمين بالنسبة للمحارم، هذا هو المشروع .

أما مسألة العورة: فالعورة للمرأة مع المرأة كالعورة للرجل مع الرجل يعني: ما بين السرة إلى الركبة، لكن ليس معنى قولنا هذا أنه يجوز للمرأة أن تخرج للنساء ليس عليها إلا سروال إلى الركبة وإلى السرة، لا أحد يقول بهذا، يعني: أي إنسان يقول بهذا فهو ضال، لكن المعنى: لو أن المرأة عليها ثياب سابغة واحتاجت إلى أن تكشف عن ذراعيها لشغل أو لمرض في الذراع أو ما أشبه ذلك، أو أرادت أن تُرْضِع طفلها أمام النساء وأخذت الثدي أمام النساء فلا بأس.
فهناك فرق بين العورة وبين اللباس المشروع، فالمشروع للنساء أن يكون لباسهن سابغاً، ويجوز أن تُخْرِج رأسها ووجهها ورقبتها وكفيها بل وذراعيها وقدميها وساقيها عند محارمها؛ لكن ليس معنى ذلك أن نقول: تلبس الثوب القصير عند محارمها، لا.
هذا شيء آخر، لكن لو فُرِض أنها -مثلاً- رَفَعت ثوبها لحاجة وأمامها المحارم وخرج الساق فلا بأس "

وعليه :
فإذا احتجتِ إلى إرضاع طفلتك في وجود النساء ، فلا حرج في ذلك ، لكن مع محاولة التستر قدر الطاقة بتغطية ما يمكن تغطيته من ذلك عند الإرضاع .
وإن تنحيت عنهم جانبا أو انتقلت إلى غرفة أخرى ، فهذا أفضل ، لأنه من الحياء والمروءة والمحافظة على الستر .
وأما الأطفال فينبغي التحرز من المميز منهم ، والذي يعرف العورة .
وينبغي للمرأة الصالحة أن تكون معلمة وهادية لأخواتها ، لينتشر الخير ، ويعم المعروف .

Can she breastfeed her baby in front of other women?

Allah has blessed me with a baby girl. Often I have my relatives or female friends with me, or I am visiting them, and I breastfeed my baby. Is it haraam to uncover my chest and breastfeed in front of them? Because I am afraid that if I breastfeed away from them they will take it badly. Please note that I only breastfeed her in front of woman or children.
Praise be to Allaah.
We have previously discussed what it is permissible for a woman to show in front of her mahrams and in front of other women. See the answer to question no. 113287, 82994, 34745 and 115351. To sum up, she should not uncover in front of women anything but that which ordinarily appears. 
With regard to uncovering the breast in order to feed her child, the scholars granted a concession allowing that because there is a need for it. 
Shaykh Ibn ‘Uthaymeen (may Allah have mercy on him) said: 
We must understand that there is a difference between saying “What is ‘awrah?” and “What is the clothing that it is prescribed for a woman to wear?” so that there will be no confusion between the two matters. 
The clothing that is prescribed for a woman to wear in front of mahrams is that which covers all of her body apart from the head, hands and feet. This is what is prescribed. 
With regard to the issue of ‘awrah, the ‘awrah for a woman in front of other women is like the ‘awrah for a man in front of other men, i.e., the area between the navel and the knee. But saying that does not mean that it is permissible for a woman to appear in front of other women wearing nothing but pants that cover from the navel to the knee. No one would say that. Whoever says such a thing is misguided. Rather what is meant is that if a woman is wearing covering clothes, and she needs to uncover her forearms to do some work or because of some disease in the forearms and like, or she wants to breastfeed her child in front of other women, so she uncovers her breast in front of the women, there is nothing wrong with that. 
So there is a difference between the concept of ‘awrah and the manner of dress that is prescribed. What is prescribed for women is that their clothing should cover them properly, and it is permissible for a woman to uncover her head, face, neck and hands, and even her forearms, feet and lower legs in front of her mahrams. But that does not mean that we say she can wear short dresses in front of her mahrams; not at all. 
This is another matter. But if we assume, for example, that she lifts up her dress for some reason, and her mahrams are present and her lower leg shows, then there is nothing wrong with that.

Based on that: 
If you need to breastfeed your child in the presence of other women, there is nothing wrong with that, but  you have to try to remain covered as much as possible, by covering whatever you can cover when breastfeeding. 
If you can go off to one side away from them, or go into another room, that is preferable, because it is part of modesty, dignity and remaining covered. 
With regard to children, you should avoid breastfeeding in front of those who have reached the age of discernment and who know what the ‘awrah is. 
The righteous woman should be a teacher and an example for her sisters, so as to spread goodness and decency.

هل يقرض أخته وهو يعلم أنها ستسدد القرض من مال حرام ؟

السؤال :

بارك الله فيكم على هذا الموقع الطيب، سؤالي هو : أن أخت زوجي تتحصل على منحة البطالة من فرنسا إلا أنها تخالف شروط الحصول على هذه المنحة، فمثلا: هي تقيم في الجزائر مع زوجها الذي يعمل ، فهي كذبت عليهم بأنها مقيمة في فرنسا ، وأن زوجها لا يعمل ، وهي تتهرب من مقابلتهم بحجة حملها كل مرة . المشكلة أن زوجي قام بتديينها مبلغا من المال لتشتري به بيتا على أن ترجعه له من المال الذي تتحصل عليه من هذه المنحة بالتقسيط ، علما أنها كان بإمكانها أن تستأجر بيتا ؛ لأن راتب زوجها جيد .

فأريد أن أعرف إذا كان هناك إثما على زوجي؛ لأنه يعرف مصدر هذا المال ؟ وما حكم المال الذي يأخذه منها لاسترجاع الدين.

وإذا أرادت أخت زوجي أن تتوب فهل عليها أن ترجع هذا المال؟

وأريدك أن تنصح إخواننا المسلمون الذين يأخذون هذه المنحة وأنا أسميها: (محنة) ؛ لأنها تضعف شخصيتهم ودينهم ويصبحون تابعين للكفار يعاملون معاملة أقل ما يقال عنها حقيرة.

الحمد لله
لا يجوز لأخت زوجك الحصول على منحة البطالة المذكورة ؛ لمخالفتها لشروط استحقاقها ، والمال الذي تأخذه من ذلك مال محرم ، يلزمها رده على أصحابه ، لكن لا حرج على زوجك في إقراضها ولو كان يعلم أنها ستسدد القرض من هذا المال ، لأنه يأخذ المال بوجه مشروع ، والإثم على الكاسبة له . والقرض يثبت في الذمة ، فلم يقع تعاقد على عين المال الحرام .
وسئل الدكتور عبد الله بن محمد العمراني عن رجل " أدان شخصاً مبلغاً من المال ويريد استرداده الآن لكن الشخص المدان سيسدد الدين من مال حرام ، فأجاب : يجب على المدين تسديد ما عليه من ديون مما اكتسبه من طريق مباح ، وللدائن الحق في استرداد دينه من المدين دون سؤال عن طريق تملكه.
وإذا أعطى المدين الدائن مالاً محرماً في طريقة تملكه فإنه جائز للدائن لاختلاف طريق التملك والإثم على المدين.
ويمكن أن يستنبط ذلك من حديث بريرة -رضي الله عنها- حينما جاءتها قطعة لحم صدقة فأهدتها للنبي -صلى الله عليه وسلم- وهو لا يقبل الصدقة فقبلها ؛ لأنها جاءته بطريق الهدية، انظر ما رواه البخاري (1495) ومسلم (1074) .
ويدل على ذلك القاعدة ( تبدل سبب الملك قائم مقام تبدل الذات) والله الموفق " انتهى من "فتاوى موقع الإسلام اليوم".
وينبغي لزوجك نصحها وتذكيرها ، ولو امتنع عن أخذ مالها الحرام لتكف عنه ، كان حسنا .

Should he lend money to his sister when he knows that she is going to pay back the loan with haraam money?


May Allah bless you for this good website. My question is:
My husband’s sister gets unemployment benefit from France, but she goes against the conditions for getting this assistance. For example, she lives in Algeria with her husband, who has a job, but she lied and told them that she was living in France and that her husband was not working. And she avoids having interviews with them on the grounds that she is pregnant at the time. The problem is that my husband has lent her some money to buy a house, on condition that she pay him back in instalments from the money that she gets as assistance. Please note that she is able to rent a house, because her husband has a good salary. 
I want to know whether there is any sin on my husband, because he knows the source of this money? What is the ruling on the money that he takes from her as repayment of the loan? 
If my husband’s sister wants to repent, does she have to return this money? 
I would like you to advise our Muslim brothers who take this assistance, which I call it a test or trial, because it weakens their character and religious commitment, and they become followers of the kuffaar and are treated in a manner about which the least that may be said is that it is despicable.

It is not permissible for your husband’s sister to get the unemployment benefit mentioned, because she has gone against the conditions of entitlement. The money that she has taken is haraam, and she has to return it to its rightful owners. But there is nothing wrong with your husband lending money to her, even if he knows that she is going to pay back the loan with this money, because he is taking the money in a manner that is acceptable according to sharee‘ah, and the sin is on the one who acquires it; the loan is the responsibility of the borrower and there is no deal concerning the haraam wealth itself.
Dr. ‘Abdullah ibn Muhammad al-‘Imraani was asked about a man who lent someone some money, and he wants to ask for it back now, but the person who borrowed it is going to pay it back with haraam wealth. He replied: The borrower has to pay back what he owes of debts with whatever he earns in a permissible manner. The lender has the right to ask the borrower to repay the debt without asking about how he acquired the money. 
If the borrower gives the lender money that is haraam in the way in which he acquired it, it is permissible for the lender because the way he is acquiring it is different, and the sin is on the borrower. 
This may be understood from the hadeeth of Bareerah (may Allah be pleased with her), when she received some meat as charity, and she gave it as a gift to the Prophet (blessings and peace of Allah be upon him), who did not accept charity, but he accepted it because it came to him as a gift. See the report narrated by al-Bukhaari (1495) and Muslim (1074). 
And Allah is the source of help.

Your husband should advise her and remind her. If he can refuse to take her haraam money so that she will stop, that would be good.

السؤال : إذا أجنب الشخص ثم اغتسل هل يلزمه أن يدلك بدنه بالمنظفات كالصابون أو لا ؟
الجواب :
الحمد لله
الواجب في الغسل من الحدث الأكبر تعميم البدن بالماء ، ولا يشترط معه الصابون أو غيره من المنظفات ؛ لأن كل من وصف غسله عليه الصلاة والسلام من الجنابة ، لم يذكروا أنه كان يغتسل من الجنابة بالسدر أو الأشنان أو غيرها من المنظفات ، بل كان يكتفي عليه الصلاة والسلام بصب الماء على بدنه فيعمه بالماء . 

فإن ذلك : ما روته عائشة رضي الله عنها أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : ( كَانَ إِذَا اغْتَسَلَ مِنْ الْجَنَابَةِ .... ثُمَّ يَصُبُّ عَلَى رَأْسِهِ ثَلَاثَ غُرَفٍ بِيَدَيْهِ ثُمَّ يُفِيضُ الْمَاءَ عَلَى جِلْدِهِ كُلِّهِ ) رواه البخاري (240) .

وعَنْ أُمِّ سَلَمَةَ رضي الله عنها قَالَتْ : قُلْتُ : يَا رَسُولَ اللَّهِ ، إِنِّي امْرَأَةٌ أَشُدُّ ضَفْرَ رَأْسِي فَأَنْقُضُهُ لِغُسْلِ الْجَنَابَةِ ؟ قَالَ : ( لا إِنَّمَا يَكْفِيكِ أَنْ تَحْثِي عَلَى رَأْسِكِ ثَلاثَ حَثَيَاتٍ ، ثُمَّ تُفِيضِينَ عَلَيْكِ الْمَاءَ فَتَطْهُرِينَ ) رواه مسلم (497) .

وسئل علماء اللجنة الدائمة (5/315) : هل الجنابة تغسل بالصابون .. ولماذا ؟

فأجابوا : "يجب الغسل من الجنابة بالماء ولا يجب فيه استعمال المنظفات كالصابون ونحوه وهذا هو الذي دلت عليه سنة النبي صلى الله عليه وسلم . وإن استعمل الصابون أو نحوه ، من المنظفات فلا بأس" انتهى .

Is it essential when doing ghusl for janaabah to wash with soap?
If a person becomes junub then does ghusl, does he have to scrub his body with cleansing materials such as soap or not?.
Praise be to Allaah.
What is required when doing ghusl in the case of major impurity is to make the water reach every part of the body. It is not stipulated that soap or any other cleansing material be used, because none of those who described the ghusl of the Prophet (blessings and peace of Allah be upon him) in the case of janaabah said anything about him using lotus leaves or any other kind of cleansing material. Rather all he (blessings and peace of Allah be upon him) did was to pour water over his body and make it reach every part. 

For example, ‘Aa’ishah (may Allah be pleased with her) narrated that the Prophet (blessings and peace of Allah be upon him), when he did ghusl in the case of janaabah, used to pour three scoops of water with his hands, then pour water over all of his skin. Narrated by al-Bukhaari, 240 
It was narrated that Umm Salamah (may Allah be pleased with her) said: I said: O Messenger of Allaah, I am a woman with tightly braided hair; should I undo it for ghusl from janaabah? He said: “No; it is sufficient for you to pour three handfuls of water over your head, then pour water over you, and you will become pure.” Narrated by Muslim, 330. 

The scholars of the Standing Committee were asked (5/315): Should one wash with soap after janaabah, and why? 

They replied: It is obligatory to do ghusl for janaabah using water, but it is not essential to use cleansing materials such as soap and the like. This is what is indicated by the Sunnah of the Prophet (blessings and peace of Allah be upon him). But if one uses soap or some other cleansing material, there is nothing wrong with that.

السؤال:
أريد أن اعرف هل ( طه ويس ) من أسماء الرسول صلى الله عليه وسلم؟ وجزاكم الله خير



الجواب :

الحمد لله

"طه" و "يس" ليسا من أسماء النبي صلى الله عليه وسلم ، وإنما هما من الحروف المقطعة التي افتتحت بها بعض سور القرآن الكريم ، إشارةً إلى إعجاز القرآن الكريم ، وأنه من نفس الحروف التي يتكلم بها العرب ، ومع هذا فقد عجزوا عن الإتيان بمثله ، مما يدل على أنه منزل من عند الله تعالى .

قال محمد الأمين الشنقيطي رحمه الله في "أضواء البيان" (4/3) " في تفسير سورة (طه) : "أظهر الأقوال فيه عندي أنه من الحروف المقطعة في أوائل السور ، ويدل لذلك أن "الطاء" و "الهاء" المذكورتين في فاتحة هذه السورة ، جاءتا في مواضع أخر لا نزاع فيها في أنهما من الحروف المقطعة ، أما "الطاء" ففي فاتحة "الشعراء" "طسم" وفاتحة "النمل" طس " . وفاتحة "القصص" وأما "الهاء" ففي فاتحة "مريم" في قوله تعالى : "كهيعص" " انتهى .

وقال الشيخ السعدي رحمه الله في تفسيره (1/501) "طه : من جملة الحروف المقطعة ، المفتتح بها كثير من السور ، وليست اسماً للنبي صلى الله عليه وسلم" انتهى .

وقال الشيخ ابن باز رحمه الله: " وليس طه وياسين من أسماء النبي صلى الله عليه وسلم في أصح قولي العلماء، بل هما من الحروف المقطعة في أوائل السور مثل ص وق ون ونحوها " انتهى من "مجموع الفتاوى" (18/54)

Are Taha and Yaseen names of the Prophet (blessings and peace of Allah be upon him)?
 
 I would like to know whether Taha and Yaseen are names of the Messenger (blessings and peace of Allah be upon him)?.
Praise be to Allaah.
Taha and Yaseen are not names of the Prophet (blessings and peace of Allah be upon him); rather they are among the separate letters that appear at the beginning of some soorahs of the Holy Qur’aan, which point to the miraculous nature of the Qur’aan and the fact that these letters are part of the language of the Arabs, yet despite that they were unable to produce anything like it, which indicates that it was revealed from Allah, may He be exalted. 

Muhammad al-Ameen ash-Shanqeeti (may Allah have mercy on him) said in Adwa’ al-Bayaan (4/3), commenting on Soorah Ta-Ha: 
The most correct opinion concerning it in my view is that these are the separate letters that appear at the beginning of some soorahs. What may prove that is the fact that the ta’ and ha’ that appear at the beginning of this soorah also appear in other places in which there is no dispute that they are among these separate letters. The letter ta’ appears at the beginning of ash-Shu‘ara’ (Soorah 26), “Ta Seen Meem”; and at the beginning of an-Naml (Soorah 27), Ta’ Seen, and at the beginning of as-Qasas (soorah 28). As for the letter ha’, it appears at the beginning of Soorat Maryam where Allah, may He be exalted, says “Kaaf Ha’ Yaa ‘Ayn Saad.” End quote.

Shaykh as-Sa‘di (may Allah have mercy on him) said in his Tafseer (1/501): “Ta-Ha” is one of the separate letters with which many soorahs begin, and it is not one of the names of the Prophet (blessings and peace of Allah be upon him). End quote.

Shaykh Ibn Baaz (may Allah have mercy on him) said: Taha and Yaseen are not names of the Prophet (blessings and peace of Allah be upon him) according to the more correct of the two scholarly opinions; rather these are some of the separate letters that appear at the beginning of some soorahs, such as saad, qaaf, noon and so on.

استغفر الله وأتوب إليه لقد ارتكبت أعظم وأكبر الكبائر وهي الزنا وأنا متزوجة وحملت بطفلة والآن عمرها 6 سنوات ونسبت إلى زوجي ، لم أستطع أن أعترف لزوجي بالقذارة التي فعلتها، خفت على أهلي وابني منه وقد تبت إلى الله توبة نصوحة وتحجبت والتزمت بصلاتي، طلبت المغفرة والعفو من الله على هذا الجرم الذي ارتكبته فهل يغفر الله لي؟ ماذا أفعل حتى تكتمل توبتي أرجوكم أفيدوني هل أعترف لزوجي حتى يغفر الله لي؟

الحمد لله
نسأل الله تعالى أن يغفر لك وأن يتجاوز عنك ، فإن الزنا ذنب عظيم ، وجرم كبير ، لا سيما ممن أنعم الله عليها بالزواج ، فبدلت نعمة الله كفرا ، وخانت زوجها ، ودنست عرضه ، ولوثت فراشه . ولهذا كان عقاب هذه المتزوجة أن ترجم بالحجارة حتى تموت ، نكالا من الله عز وجل ، والله عزيز حكيم .
لكن من رحمته سبحانه أنه يلطف بعبده ، ويمهله ، ويدعوه للتوبة ، ويقبلها منه ، ويثيبه عليها ، فما أرحمه ، وما أعظمه ، وما أكرمه سبحانه وتعالى .
قال عز وجل : ) وَالَّذِينَ لا يَدْعُونَ مَعَ اللَّهِ إِلَهاً آخَرَ وَلا يَقْتُلُونَ النَّفْسَ الَّتِي حَرَّمَ اللَّهُ إِلَّا بِالْحَقِّ وَلا يَزْنُونَ وَمَنْ يَفْعَلْ ذَلِكَ يَلْقَ أَثَاماً يُضَاعَفْ لَهُ الْعَذَابُ يَوْمَ الْقِيَامَةِ وَيَخْلُدْ فِيهِ مُهَاناً إِلَّا مَنْ تَابَ وَآمَنَ وَعَمِلَ عَمَلاً صَالِحاً فَأُولَئِكَ يُبَدِّلُ اللَّهُ سَيِّئَاتِهِمْ حَسَنَاتٍ وَكَانَ اللَّهُ غَفُوراً رَحِيماً ) الفرقان/68- 70
فاستمري في توبتك وإنابتك ، وتضرعي إلى الله تعالى أن يقبلها منك ، والله تعالى يتوب على من تاب .
وإن من مبشرات قبول التوبة أن يستر الله عبده ، ولا يفضحه ، وأن يمد له في العمر حتى يتقرب إليه ، ويصلح حاله معه ، ونحمد الله تعالى أن وفقك للالتزام والحجاب ، والطاعة والإنابة ، ولعل الله الكريم الرحيم أن يكون قد عفى عنك وغفر لك ، نسأل الله ذلك .
وإذا كان الله قد سترك ، فلا تهتكي ستر الله عليك ، ولا تخبري زوجك ولا أحداً غيره بشيء مما كان ، وتوبتك هي الندم والاستقامة وإصلاح الأعمال .
وأما الولد ، فإنه ينسب لزوجك ، ولا ينتفي نسبه منه إلا إذا نفاه باللعان ، لأن الأصل أن الولد للفراش كما قال النبي صلى الله عليه وسلم .
وقد سئل علماء اللجنة الدائمة : امرأة متزوجة زنت وهي في عصمة زوج، ومن ثم حملت ووضعت حملها بولد ذكرا كان أو أنثى ، فلمن يبقى معه ذلك الولد ، أيبقى مع زوجها بدليل الحديث: (الولد للفراش وللعاهر الحجر) أم لا ؟ وإن بقي مع زوج أمه الشرعي أيتبنى به ويحسبه كأحد أولاده في جميع الحقوق أم يكون عنده في ملكه فقط ، أما إذا لحقه بالعاهر أيحسبه بأولاده الحقيقي أم يمسكه معهم وهو لم يزل على حالة ولد زنا ؟
فأجابوا : "إذا زنت امرأة متزوجة وحملت فالولد للفراش ؛ للحديث الصحيح ، وإن أراد صاحب الفراش نفيه بالملاعنة فله ذلك أمام القضاء الشرعي ، ولا يكون مملوكا لأحد بإجماع المسلمين ، وأما التبني فلا يجوز ولا يصير به الولد المتبنَّى ولدا لمن تبناه. وبالله التوفيق " انتهى . "فتاوى اللجنة الدائمة" (20/339) .

She committed zina when she was married; to whom should the child be attributed?
 I ask Allaah for forgiveness and I repent to him, for I have committed the worst and greatest of major sins, namely zina (adultery) when I was married. I got pregnant with a daughter who is now 6 years old, and is named after my husband. I cannot tell my husband of the awful thing that I did, because I am afraid for my family and my son from him. I have repented to Allaah sincerely, and I have put on hijab and I pray regularly. I have asked for forgiveness and pardon from Allaah for this crime that I committed. Will Allaah forgive me? What should I do in order to make my repentance complete? I hope that you can advise me. Should I tell my husband so that Allaah will forgive me?.

We ask Allaah to forgive you and pardon you, for zina is a major sin and a serious crime, especially on the part of one whom Allaah has blessed with marriage, but she was ungrateful for the blessing of Allaah, betrayed her husband, transgressed his honour and contaminated his bed. Hence the punishment for this married woman is to be stoned to death, as a punishment from Allaah, and Allaah is Almighty and Most Wise. 
But by His Mercy, He shows kindness to His slaves, gives them respite and invites them to repent, and He accepts repentance and gives reward for it. How merciful, great and kind He is, may He be glorified and exalted. 
Allaah says (interpretation of the meaning): 
“And those who invoke not any other ilaah (god) along with Allaah, nor kill such person as Allaah has forbidden, except for just cause, nor commit illegal sexual intercourse ___and whoever does this shall receive the punishment.
69. The torment will be doubled to him on the Day of Resurrection, and he will abide therein in disgrace;
70. Except those who repent and believe (in Islamic Monotheism), and do righteous deeds; for those, Allaah will change their sins into good deeds, and Allaah is Oft‑Forgiving, Most Merciful”
[al-Furqaan 25:68-70] 
So continue repenting and turning to Him, beseeching Allaah to accept it from you, and Allaah accepts the repentance of those who repent. 
One of the signs that Allaah has accepted repentance is that He conceals His slave and does not expose him, and He extends his life span so that he will draw close to Him and make his peace with Him. We praise Allaah for having helped you to pray regularly and wear hijab, and to obey Him and repent. We hope that Allaah, the Most Generous and Most Merciful, has forgiven you, and we ask Him to do that. 
If Allaah has concealed you, then do not break that concealment that He has bestowed upon you, and do not tell your husband or anyone else anything about what happened. Your repentance is regret and righteousness and doing good deeds. 
As for the child, he is to be named after your husband, and that is not cancelled out unless he rejects the child by means of li’aan, because the basic principle is that the child belongs to the marital bed, as the Prophet (peace and blessings of Allaah be upon him) said. 
The scholars of the Standing Committee were asked: There is a married woman who committed zina when she was still married. She got pregnant as a result and gave birth to a child, either male or female. With whom should that child stay? Should he stay with her husband based on the hadeeth “The child is for the (owner of the) bed and the fornicator gets nothing” or not? If he stays with his mother’s husband, should he adopt him and regard him as one of his own children with regard to all rights, or will he just be under his care only? But if he is attributed to the adulterer, should he regard him as one of his real children or keep him with him even though he is still illegitimate?  
They replied: If a married woman commits zina and becomes pregnant, then the child belongs to the (owner of the) bed (i.e. the husband), because of the saheeh hadeeth. If the owner of the bed wants to deny the child by engaging in li’aan then he may do that before the shar’i judge, and in that case the child does not belong to anyone according to the consensus of the Muslims. But adoption is not permissible and the adopted child does not truly become the child of the one who adopted him. And Allaah is the source of strength.

حكم دفع الإنسان زكاة ماله إلى حماته ، وهل له أن يأكل من طعامها الذي تشتريه من مال الزكاة ؟

السؤال :
هل يجوز إعطاء الزكاة لجدتي من أمي ، فهل يجوز لأبي أن يعطي زكاته لحماته ؟ تريد أمي أن تزور جدتي ( والدة أمي ) و هي فقيرة جداً تعيش على الزكوات فهل يجوز لوالدتي أن تقيم و تأكل معها لمدة أيام قليلة أم ينبغي عليها أن تشتري طعامها في هذه الفترة التي تقيم فيها ؟
وإذا ذهبت لزيارة جدتي و عرضت علي الطعام هل يجوز لي أن أكل من هذا الطعام الذي أعلم أنه أتى من مال الزكاة ؟

الجواب :
أولاً :
لا حرج في دفع الإنسان زكاةَ ماله لحماته ، بل هي أولى من غيرها إن كانت فقيرةً ومحتاجة ، لما بينهما من نسب ومصاهرة .
وأما الحفيد فليس له أن يدفع زكاة ماله لجدته ، إلا في الحال التي لا يكون ملزماً بالنفقة عليها .

ثانياً :
لا حرج عليكم من الأكل من طعام جدتكم ، ولو كان هذا الطعام من مال الزكاة ؛ فمن القواعد المقررة عند العلماء : أن الشيء يتغير حُكْمُه بتغير سبب مُلكه .
ويدل على ذلك ما رواه البخاري (5279) ومسلم (1074) عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا قَالَتْ : دَخَلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَالْبُرْمَةُ تَفُورُ بِلَحْمٍ [ البرمة : القِدْر ] ، فَقُرِّبَ إِلَيْهِ خُبْزٌ وَأُدْمٌ مِنْ أُدْمِ الْبَيْتِ .
فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : أَلَمْ أَرَ بُرْمَةً فِيهَا لَحْمٌ .
فَقَالُوا : بَلَى يَا رَسُولَ اللَّهِ ، وَلَكِنْ ذَلِكَ لَحْمٌ تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ ، وَأَنْتَ لَا تَأْكُلُ الصَّدَقَةَ .
فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : ( هُوَ عَلَيْهَا صَدَقَةٌ ، وَهُوَ لَنَا هَدِيَّةٌ ) 1.
فأقام صلى الله عليه وسلم تبدل سبب الملك مقام تبدل العين .
فالصدقة إذا قبضها الفقير صارت ملكاً له ، وزال عنها وصف الصدقة ، وله أن يتصرف بها كما يشاء ، من بيع أو هبة أو غير ذلك .
قال النووي : " فيه دَلِيل عَلَى أَنَّهُ إِذَا تَغَيَّرَتْ الصِّفَة تَغَيَّرَ حُكْمُهَا ، فَيَجُوز لِلْغَنِيِّ شِرَاؤُهَا مِنْ الْفَقِير ، وَأَكْلهَا إِذَا أَهْدَاهَا إِلَيْهِ ، وَلِلْهَاشِمِيِّ ، وَلِغَيْرِهِ مِمَّنْ لَا تَحِلّ لَهُ الزَّكَاة اِبْتِدَاءً ". انتهى ، "شرح صحيح مسلم" (5/274).
وقال الحافظ ابن حجر : " فيؤخذ منه أن التحريم إنما هو على الصفة ، لا على العين ". انتهى ، " فتح الباري" (5/204).
وقال ابن القيم : " وفى أكله صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِن اللحم الذي تُصدِّقَ به على برَيرة .. دليلٌ على جواز أكل الغني ، وبني هاشم ، وكل من تحرم عليه الصدقة مما يُهديه إليه الفقير من الصدقة ؛ لاختلاف جهة المأكول ". انتهى ، "زاد المعاد" (5/175).
وقال الشيخ ابن عثيمين : " دل ذلك على أن الإنسان إذا قبض الشيء بحق ، فإنه لا يَحرم على غيره ممن لو قبضه من المعطي الأول لم يحل.
ونظير ذلك الفقير يأخذ الزكاة ، ويجوز أن يصنع به طعاماً يدعو إليه الأغنياء ، فيأكلون منها ؛ لأن الغني لم ينتفع به على أنه زكاة ، بل على أنه من هذا الفقير الذي ملكه بحق ". انتهى ، من موقع الشيخ :

والحاصل :
أن الفقير إذا تُصدِّق عليه ، فأهدى من صدقته إلى من لا تحل له الصدقة ، من غني وغيره ، فإهداؤه جائز ، وللغني الأكل منها دون أي حرج .

Ruling on giving zakaah to one’s mother in law; can he eat from her food that she buys with zakaah money?


I wanted to know if it is permissible for me to give zakaat to my grandmother(mums mother),is it permissible for my dad to give zakaat to his mother-in-law?(my mums mother)My mum wants to visit her mother who is very poor and entirely depends on zakaat,is it okay for my mum to eat and live with them for a few days or should she buy her own food and live elsewhere? If i go to visit my grandmother and she offers me food,should i accept knowing that it came from zakaah money?.

Firstly: 
There is nothing wrong with a person giving his zakaah to his mother in law; rather she is more entitled than others if she is poor and needy, because of the ties through marriage that exist between them. 
With regard to the grandson, he does not have the right to give his zakaah to his grandmother unless he is not obliged to spend on her.

Secondly: 
There is nothing wrong with you eating from your grandmother’s food, even if it is part of the zakaah. One of the basic principles of the scholars is that the ruling on a thing changes if the means of acquiring it change. 
This is indicated by the report narrated by al-Bukhaari (5279) and Muslim (1074) from ‘Aa’ishah (may Allah be pleased with her) who said: The Messenger of Allah (blessings and peace of Allah be upon him) came in and there was some meat in the pot, but some bread and condiments were brought to him. 
The Messenger of Allah (blessings and peace of Allah be upon him) said: “Don’t I see a pot with some meat in it?” 
They said: Yes, O Messenger of Allah. But that is some meat that was given in charity to Bareerah, and you do not consume charity. 
The Messenger of Allah (blessings and peace of Allah be upon him) said: “It is charity for her and a gift for us.” 
Once the poor person takes possession of that which is given in charity, it becomes his property and is not longer regarded as “charity”; he may then dispose of it however he wants, by selling it, giving it away, and so on. 
An-Nawawi said: This indicates that if the description changes, the ruling also changes, so it is permissible for a rich person to buy it from the poor person or to take it if it is given to him or to a Haashimi (descendent of Banu Haashim) or to anyone else for whom zakaah per se is not permissible. End quote. 
Sharh Saheeh Muslim, 5/274 
Al-Haafiz Ibn Hajar said: It may be understood from this that the prohibition of a thing is connected to its description (i.e., whether it is zakaah and so on), not the thing itself. End quote from Fath al-Baari, 5/204 

Ibn al-Qayyim said: The fact that the Prophet (blessings and peace of Allah be upon him) ate some of the meat that had been given in charity to Bareerah indicates that it is permissible for the rich, Banu Haashim and anyone for whom zakaah is haraam to eat what is given to him by a poor person who received it as charity.

Shaykh Ibn ‘Uthaymeen said: That indicates that if a person acquires something lawfully, it is not haraam for another person for whom it would not be permissible if he had received it from the first giver. 
Similar to that is the poor person who receives zakaah: it is permissible for him to make food with it and invite rich people to come and eat from it, because the rich person is not benefiting from it on the basis that it is zakaah; rather it is on the basis that it came from this poor person who took possession of it lawfully.

To sum up: 

If zakaah is given to a poor person and he gives some of it to a person for whom zakaah is not permissible, whether he is a rich man or otherwise, his giving it to him is permissible and the rich man may eat from it without any problem.

 هل من السنة الإكثار من الصيام في شهر محرم ؟ وهل لهذا الشهر مزية على غيره من الشهور ؟.

الحمد لله
فإن شهر محرم هو أول الشهور العربية وهو من أشهر الله الحُرم الأربعة ، قال تعالى : ( إن عدة الشهور عند الله اثنا عشر شهراً في كتاب الله يوم خلق السموات والأرض منها أربعةٌ حرم ذلك الدين القيم فلا تظلموا فيهن أنفسكم ) التوبة / 36
أخرج البخاري (3167) ومسلم (1679) عَنْ أَبِي بَكْرَةَ رَضِيَ اللَّهُ عَنْهُ عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ الزَّمَانُ قَدْ اسْتَدَارَ كَهَيْئَتِهِ يَوْمَ خَلَقَ اللَّهُ السَّمَوَاتِ وَالأَرْضَ السَّنَةُ اثْنَا عَشَرَ شَهْرًا مِنْهَا أَرْبَعَةٌ حُرُمٌ ثَلاثَةٌ مُتَوَالِيَاتٌ ذُو الْقَعْدَةِ وَذُو الْحِجَّةِ وَالْمُحَرَّمُ وَرَجَبُ مُضَرَ الَّذِي بَيْنَ جُمَادَى وَشَعْبَانَ " .
وثبت عن النبي صلى الله عليه وسلم أن أفضل الصيام بعد رمضان صيام شهر محرم فعَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَفْضَلُ الصِّيَامِ بَعْدَ رَمَضَانَ شَهْرُ اللَّهِ الْمُحَرَّمُ وأفضل الصلاة بعد الفريضة صلاة الليل " رواه مسلم 1163
قوله : ( شهر الله ) إضافة الشّهر إلى الله إضافة تعظيم ، قال القاري : الظاهر أن المراد جميع شهر المحرَّم .
ولكن قد ثبت أنّ النبي صلى الله عليه وسلم لم يصم شهراً كاملاً قطّ غير رمضان فيُحمل هذا الحديث على الترغيب في الإكثار من الصّيام في شهر محرم لا صومه كله .

The virtue of observing a lot of naafil fasts in the month of Muharram


Is it Sunnah to observe a lot of naafil [supererogatory] fasts in the month of Muharram? Is there anything special about this month compared with other months?.
Praise be to Allaah.  
The month of Muharram is the first month of the Arabic year, and it is one of the four sacred months of Allaah. Allaah says (interpretation of the meaning): 
“Verily, the number of months with Allaah is twelve months (in a year), so was it ordained by Allaah on the Day when He created the heavens and the earth; of them four are Sacred (i.e. the 1st, the 7th, the 11th and the 12th months of the Islamic calendar). That is the right religion, so wrong not yourselves therein”
[al-Tawbah 9:36] 
al-Bukhaari (3167) and Muslim (1679) narrated from Abu Bakrah (may Allaah be pleased with him) that the Prophet (peace and blessings of Allaah be upon him) said: “The division of time has turned to its original form which was current the day Allaah created the heavens and earth. The year consists of twelve months of which four are sacred: three consecutive months, Dhu’l-Qa’dah, Dhu’l-Hijjah and Muharram, and Rajab of Mudar which comes between Jumada and Sha’baan.” 
It was proven from the Prophet (peace and blessings of Allaah be upon him) that the best fasting after Ramadaan is fasting in the month of Muharram. It was narrated that Abu Hurayrah (may Allaah be pleased with him) said: The Messenger of Allaah (peace and blessings of Allaah be upon him) said: “The best fasting after Ramadaan is the month of Allaah Muharram, and the best prayer after the obligatory prayer is prayer at night.” Narrated by Muslim, 1163. 
With regard to the phrase “the month of Allaah”, mentioning the month in conjunction with Allaah is a sign of its great status. Al-Qaari said: it seems that what is meant is all of the month of Muharram. 
But it was proven that the Prophet (peace and blessings of Allaah be upon him) did not fast any month in full apart from Ramadaan, so this hadeeth is to be understood as meaning that it is it is encouraged to fast a lot in the month of Muharram, not to fast the whole month.

La sunna enseigne-t-elle le fréquent recours au jeûne pendant le mois de Muharram ? Ce mois possède-t-il un mérite particulier par rapport aux autres mois ?

Louanges à Allah
Le mois de Muharram est le premier mois du calendrier arabe et l’un des quatre mois sacrés d’Allah. A ce propos le Très Haut dit : « Le nombre de mois, auprès d' Allah, est de douze (mois), dans la prescription d' Allah, le jour où Il créa les cieux et la terre. Quatre d' entre eux sont sacrés: telle est la religion droite. (Durant ces mois), ne faites pas de tort à vous-mêmes. Combattez les associateurs sans exception, comme ils vous combattent sans exception. Et sachez qu' Allah est avec les pieux.» (Coran, 9 : 36). Al-Boukhari (3167) et Mouslim (1679) ont rapporté d’après Abou Bakrata que le Prophète (bénédiction et salut soient sur lui) a dit : « Le temps a repris son cours tel qu’il était quand Allah créa les cieux et la terre : l’année compte douze mois dont quatre mois sacrées ; les trois se succèdent et ont pour nom Dhoul-Qa’ada, Dhoul Hidjdja et Muharram et le quatrième Rajab intercalé entre Djoumadaa et Chabaane.
Il a été rapporté de façon sûre d’après le Prophète (bénédiction et salut soient sur lui) que le jeûne effectué en Muharram est le meilleur après celui du Ramadan. A ce propos, Abou Hourayra (P.A.a) dit : « Le Messager d’Allah (bénédiction et salut soient sur lui) a dit : « le meilleur jeûne après celui du Ramadan est le jeûne effectué pendant le mois d’Allah, Muharram. Et la meilleure prière faite après la prière obligatoire est celle effectuée dans la nuit (rapporté par Mouslim, 1163).
Le fait d’annexer le mois à Allah en disant le mois d’Allah vise à en montrer l’importance. Selon al-Quari, il s’agit de jeûner tout le mois de Muharram. Cependant il a été rapporté de façon sûre que le Prophète (bénédiction et salut soient sur lui) n’a pas jeûné un mois complet en dehors du Ramadan. Ce qui permet de comprendre que le présent hadith ne vise que de nous inciter à une fréquente pratique du jeûne au mois de Muharram sans aller jusqu’à jeûner tout le mois. Allah le sait mieux.
